These Terms of Service ("Terms") govern your access to and use of the website, services, and products provided by Open Medical Publishing LLC ("we," "us," or "our") at openmedicalpublishing.org and its subdomains. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing our website, creating an account, submitting a manuscript, paying an invoice, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of our services immediately.

2. Services

Open Medical Publishing provides open access academic publishing services, including but not limited to:

  • Manuscript submission, peer review, and publication
  • Invoicing and payment processing for article processing charges (APCs)
  • SMS and email notifications related to invoices and publishing activities
  • Access to published research articles

3. Accounts

Certain features of our services require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to update it as necessary. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be compromised.

4. Article Processing Charges & Payments

  • Authors are responsible for paying applicable article processing charges (APCs) upon acceptance of their manuscript.
  • All fees are stated in US Dollars unless otherwise indicated.
  • Payment is due upon receipt of invoice unless other terms are agreed in writing.
  • Payments are processed securely through Stripe. We do not store your full payment card details.
  • Accepted articles will not be published until full payment has been received.
  • APCs will not be refunded when articles are retracted due to author misconduct.

5. Refund Policy

Refunds may be issued at our discretion in the following circumstances:

  • Duplicate or erroneous payments
  • Manuscript withdrawal prior to publication (subject to any applicable processing fees already incurred)
  • Service errors on our part

Refund requests must be submitted in writing to openmedicalpublishing@openmedicalpublishing.org. Approved refunds will be processed to the original payment method within 10 business days.

6. SMS Communications

By providing a phone number in connection with an invoice, you consent to receive transactional SMS messages from Open Medical Publishing. These messages are limited to invoice-related notifications (new invoices, payment reminders, payment confirmations, refund notices) and replies to messages you initiate.

  • Message frequency varies based on your invoice activity.
  • Message and data rates may apply.
  • You may opt out at any time by replying STOP.
  • Reply HELP for assistance.
  • Carriers are not liable for delayed or undelivered messages.

We will not use your phone number for marketing or promotional messages. Your phone number will not be shared with third parties for their marketing purposes. See our Privacy Policy for more details on how we handle your information.

7. Intellectual Property

7.1 Published Content

All articles published by Open Medical Publishing are distributed under open access licenses as specified on each article. Authors retain copyright to their work.

7.2 Website Content

The design, layout, graphics, logos, and other non-article content on our website are the property of Open Medical Publishing LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

8. Prohibited Conduct

You agree not to:

  • Use our services for any unlawful purpose or in violation of any applicable law or regulation
  • Submit fraudulent, plagiarized, or fabricated manuscripts or data
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the operation of our website or services
  • Use automated tools (bots, scrapers, crawlers) to access our services without our express permission
  • Submit false or misleading information in invoices, payments, or account registration

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Open Medical Publishing LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use our services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Open Medical Publishing LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of our services, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on our website with a revised "Effective Date." Your continued use of our services after any changes constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Open Medical Publishing LLC regarding the use of our services.
